Das Werk untersucht das staatliche Rollenverständnis des zum 1. Dezember 2011 in Kraft getretenen Produktsicherheitsgesetzes (ProdSG). Nach einer einleitenden Darstellung der historischen Hintergründe und der Entwicklung des allgemeinen Produktsicherheitsrechts setzt sich die Autorin im Detail mit den produktsicherheitsgesetzlichen Steuerungselementen auseinander. Einem akteursbezogenen Ansatz folgend klassifiziert sie diese jeweils nach ihrer Zugehörigkeit zur privaten oder staatlichen Verantwortungssphäre. Hierauf basierend bestimmt sie das normative Leitbild des ProdSG, dessen praktische Umsetzung sie sodann anhand der Marktüberwachungspraxis reflektiert. Die Darstellung schließt mit einer kritischen Würdigung des Produktsicherheits- und Marktüberwachungspakets der Europäischen Union, das eine weitere Etappe der Rechtsentwicklung auf dem Gebiet der Product Compliance eingeleitet hat.|The last century witnessed a fundamental transformation of the role of the state with regard to product safety. This book examines the processes that led to the state's sharply increasing influence and responsibilities culminating in the adoption of the German Product Safety Act on December 1, 2011. Particular attention is given to the increasing influence of EU law. Dörte Gauger addresses the instruments of control legislators employ to guarantee product safety and delineates the actions of the players involved to classify the requirements laid down in product safety law, distinguishing between the supervision of the state and the responsibility of private entities. As a result, she is able to identify the normative paradigm of the German Product Safety Act and to examine, in a subsequent step, the practical implementation of this paradigm through the example of the market surveillance practices of the Federal State of Baden-Württemberg. The book concludes with a critical assessment of the European Union's impact on product safety and market surveillance provisions, which initiated a new stage in product compliance.
