The draft legislation and its explanatory memorandum have been fundamentally revised for the new edition. This revision has been prompted not only by recent medical developments but also by the ongoing and highly contentious debate on assisted dying. In particular, the evolving jurisprudence following the Federal Constitutional Court's landmark decision of 26 February 2020 on the right to a self-determined death has opened up new critical perspectives. Against this backdrop, updating the comparative legal perspective likewise provides an opportunity to reassess one's own position within the full range of regulatory approaches and alternatives. In this way, the federal legislature may succeed in fulfilling its constitutional obligation to regulate suicide prevention and assisted dying in an appropriate manner.
